StoriesPublished Terms and Conditions

1. About these terms

These Terms and Conditions (the "Terms") govern your use of storiespublished.com and any related services, apps, and author store pages (together, the "Platform"). By creating an account, listing a product, or placing an order, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, please do not use the Platform.

2. Who operates the Platform

The Platform is managed and operated by Blue Ink Media Solutions [insert registered entity type and registration number] and ACX Outsourcing Hub, Inc. (SEC Registration No. 2022050052676-57), both based in the Philippines (together, "StoriesPublished," "we," "us," or "our"). Blue Ink Media Solutions manages author relations, publishing, and marketing services. ACX Outsourcing Hub, Inc. provides the technology, hosting, payment processing integration, and customer support for the Platform. [Confirm this division of roles.]

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to create an account or sell on the Platform. Minors may buy only with the involvement of a parent or guardian.

You agree to give accurate account information and to keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Tell us right away at [support email] if you believe your account has been accessed without permission.

There are two kinds of accounts.

  • Author accounts let you create a store page, list books and merchandise, and use our marketing tools.
  • Customer accounts let you buy products, track orders, and follow authors. You may also check out as a guest.

4. Author content and ownership

You keep full ownership of your books, cover art, characters, text, images, and any other material you upload ("Author Content"). We do not claim any rights in your work beyond what we need to run your store.

By uploading Author Content, you give us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, print, format, and distribute it for the purpose of selling and promoting your products on the Platform and in our marketing. This license ends when you remove the content or close your account, except for orders already placed and promotional material already published.

You confirm that you own or have permission to use everything you upload, and that it does not infringe anyone's copyright, trademark, privacy, or other rights. You are responsible for any ISBNs, permissions, and third-party licenses your work requires.

5. Listings and merchandise

Authors may list print books, e-books, audiobooks [confirm], and merchandise such as shirts, posters, pens, and custom items. You are responsible for the accuracy of your product descriptions, pricing, and content warnings. Merchandise is produced on demand by us or our fulfillment partners, and product mockups are representations only. Small differences in color, placement, and sizing may occur.

We may review, edit for formatting, decline, or remove any listing that breaks these Terms or that we reasonably believe could harm customers, authors, or the Platform.

6. Fees, royalties, and payouts

Fees and royalty rates are listed on our pricing page and in your author dashboard, and they form part of these Terms. [Insert plan fees, commission per sale, and royalty percentage, or link to the pricing page.]

Royalties are calculated on the sale price after taxes, shipping, payment processing fees, production costs, and refunds. Payouts are made [monthly] once your balance reaches [minimum payout amount], through the payout method you choose in your dashboard. You are responsible for any taxes due on your earnings and for giving us the tax information we may need.

If an order is refunded or charged back after a payout, we may deduct that amount from your future earnings. We will give you at least 30 days' notice before changing fees or royalty rates.

7. Orders and payment

When you place an order, you are making an offer to buy. We accept it when we send an order confirmation. Prices are shown in [currency] and may not include taxes, duties, or shipping, which are added at checkout.

Payments are handled by third-party payment processors [e.g., PayPal, Stripe, PayMongo]. We do not store your full card details. We may cancel an order if a product is unavailable, if there is a pricing error, or if we suspect fraud, and we will refund any amount already charged.

8. Production and shipping

Print books and merchandise are made to order. Production usually takes [3 to 7] business days before shipping. Delivery estimates are shown at checkout and are not guaranteed. Risk of loss passes to you when the order is handed to the carrier. You are responsible for giving a correct shipping address and for any customs duties in your country.

E-books and other digital products are delivered by download link or to your library on the Platform. Digital products are licensed for your personal use only and may not be copied, shared, or resold.

9. Marketing services

Authors may buy optional marketing services such as launch campaigns, advertising management, social content, and promotional design. The scope, price, and timeline of each service are set out in the service description or order form you accept. We will do the work with care and skill, but we cannot guarantee a specific number of sales, reviews, rankings, or followers. Advertising spend paid to third-party platforms is non-refundable once spent.

10. Prohibited content and conduct

You may not use the Platform to do any of the following.

  • Upload content you do not have the rights to, including plagiarized text or copied cover art
  • Sell content that sexualizes minors, promotes violence or hatred, or is otherwise illegal
  • Mislead customers about a product, an author's identity, or reviews
  • Post fake reviews or manipulate sales rankings
  • Interfere with the Platform's security, scrape data, or upload malicious code
  • Use another person's account or personal information without permission

11. Platform intellectual property and takedowns

The StoriesPublished name, logo, website design, and software belong to us or our licensors. You may not use them without our written permission, except to link to your author store.

If you believe content on the Platform infringes your copyright or other rights, send a notice to [legal/takedown email] with your contact details, a description of the work, the link to the content, and a statement that you are the rights holder or authorized to act for them. We will review it promptly and may remove the content and notify the author, who may respond.

12. Suspension and termination

You may close your account at any time from your dashboard or by contacting us. We may suspend or close an account that breaks these Terms, puts customers at risk, or is inactive for more than [24] months, after giving notice where we reasonably can. Earned royalties that are not subject to refunds, chargebacks, or a dispute will be paid out after closure. Sections that by their nature should survive, including ownership, payment obligations, disclaimers, and liability limits, continue after termination.

13. Disclaimers

The Platform is provided "as is" and "as available." We work to keep it running and secure, but we do not promise it will be uninterrupted or error free. Authors are solely responsible for the content of their books and products, and views expressed in them are not ours.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential losses, including lost profits, lost sales, or lost data. Our total liability for any claim relating to the Platform is limited to the amount you paid us, or the royalties we owe you, in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

15. Indemnity

You agree to defend and hold us harmless from claims, losses, and costs, including reasonable legal fees, that arise from your content, your products, or your breach of these Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, including the Electronic Commerce Act (Republic Act No. 8792) and the Internet Transactions Act (Republic Act No. 11967). We encourage you to contact us first so we can try to resolve any issue informally within 30 days. If that does not work, disputes will be brought before the proper courts of Mandaue City, Cebu, Philippines, unless the law of your country gives you the right to bring a claim where you live.

17. Changes and contact

We may update these Terms from time to time. We will post the new version with a new effective date and notify account holders by email of material changes at least 15 days before they take effect. Continued use of the Platform after that date means you accept the updated Terms.
